Welcome to Slamgator.com. The following terms apply if you choose to access or interact with the Slamgator servers or website including services and content provided on the website. By opening or accessing this site, you accept to observe these terms of service. Additionally, when using certain services offered on the site, you accept to follow all relevant guidelines set for Slamgator services and understand that these guidelines are always subject to change. In case you disagree with any clause in these terms of service, or any modifications that may arise in due course or in whichever way become displeased with Slamgator, you should immediately stop accessing the Site. Slamagator reserves the right, although we cannot be obligated to firmly execute the Terms of Service using filters, usage moderation, self-assistance, active inquiry, indictment, and prosecution. Moreover, by agreeing to these terms you also agree to the Slamgator privacy policy (slamgator.com/privacy policy/), and posting guidelines (slamgator.com/guidelines/) which are both part of the Terms.
THESE TERMS SERVE AS CONTRACT THAT LEGALLY BINDS YOU AS A USER AND SLAMGATOR. THEREFORE, KINDLY READ THE TERMS CAREFULLY BEFORE ACCESSING OR USING SLAMGATOR. ANY ACTION YOU UNDERTAKE ON THE SITE INCLUDING ACCESSING, USING, SUBSCRIBING, DOWNLOADING AND/OR PURCHASING MEANS THAT YOU ADMIT TO HAVE READ AND UNDERSTOOD THE TERMS AND THEREFORE AGREE TO REMAIN BOUND BY THEM. SAFETY RULES AND AGE RESTRICTIONS. SLAMGATOR CAN ONLY BE USED BY ADULTS (PERSONS AGED 18 YEARS OR MORE).
ADULTS ARE NOT ALLOWED TO USE SLAMGATOR. PEOPLE AGED BELOW 18 YEARS (OR 21 YEARS IN COUNTRIES WHERE 18 YEARS IS NOT CONSIDERED THE THRESHOLD OF ADULTHOOD) MAY NOT IN ANY WAY ACCESS, USE OR SUBSCRIBE TO SLAMGATOR.
YOU SHOULD BE OF LEGAL AGE. YOU HEREBY DECLARE AND CONFIRM THAT INDEED YOU ARE LEGALLY AN ADULT (18 YEARS AND ABOVE OR 21 YEARS IN COUNTRIES WHERE 18 YEARS IS NOT CONSIDERED THE THRESHOLD OF ADULTHOOD) ABLE TO FORM AND ACCOMPLISH ALL THE REQUIREMENTS STIPULATED IN THIS CONTRACT.
SAFETY. SLAMGATOR DOES NOT TAKE ANY RESPONSIBILITY FOR YOUR ACTIONS OR THE WAY YOU AND OTHER USERS INTERACT OR SHARE INFORMATION ON THE SITE.
SLAMGATOR DOES NOT PERFORM ANY BACKGROUND CHECKS ON ITS USERS. THEREFORE, SLAMGATOR CANNOT CONFIRM THE VALIDITY OF USER PROVIDED INFORMATION INCLUDING HEALTH STATUS AND PHYSICAL FITNESS. Additionally, SLAMGATOR DOES NOT TAKE RESPONSIBILITY FOR LEGAL ACTIONS OR REPERCUSSIONS OF USE THAT MAY ARISE IN COUNTRIES/REGIONS WHERE INTERACTIONS MAY BE CRIMINALIZED OR LIMITED. IT IS UP TO YOU TO EVALUATE AND DETERMINE WHETHER YOUR COUNTRY/REGION CRIMINALIZES OR RESTRICTS USE OF SUCH AN APPLICATION AND MAKE INFORMED DECISIONS BASED ON YOUR FINDINGS.
MODIFICATION. Slamgator has the right and legal ability to make modifications, changes or alterations to these terms of service at any particular time and without notice. Any changes to the Terms shall become binding immediately after they are posted. You therefore need to examine this agreement from time to time to ensure that you are acquainted with any modifications. LICENSE. By agreeing to these Terms of Service and you are (1) legally an adult aged 18+, capable of using Slamgator and abiding by the stipulated Terms, or (2) using Slamgator in the interest of an organization, thus binding the organization to the stipulated Terms, we offer you a restricted, non-exclusive, revocable, and non-transferable license to utilize Slamgator according to the Terms. It is illegal to use Slamgator without a license. You may not recreate, reproduce, distribute, sell, or license any content on Slamgator excluding posts created by you. You give us an abiding, irrevocable, unrestricted, universal, fully paid up, sublicensable right and license to utilize, copy, present, distribute, and recreate and reproduce any of your postings. Any unauthorized use of the Site will immediately result in the termination of any authorization or license granted.
CONTENT. Also, you are aware that all user-generated content be it posts, messages, texts, documents, images, videos, or sounds shared linked to or shared via Slamgator are solely the responsibility of their originators. This means that you are solely responsible for any content you share, post, email, or display on Slamgator. You are aware that Slamgator has no responsibility or control over any content made or transmitted using its services, hence, you may come across aggressive, inappropriate, incorrect, distorted or distasteful content. Moreover, Slamagator is not responsible for content displayed on other websites linked to its site, services or content. Therefore, Slamgator does not in any way affirm the correctness, completeness or legitimacy of the content provided in such sites. You are responsible for any damage or harm you may suffer by following links to other websites. You acknowledge that you accept the risk involved with the usage of any third-party content, Slamgator does not advocate for such content and it shall not be held liable if the usage of any content shared, emailed or displayed on Slamgator causes any kind of loss or harm.
USE. You may not use or offer software (excluding general email client and web browser applications) or any services that interface or work together with Slamgator, e.g. for mobile use, to post, download, upload, create/access/use an account, flag, email or search. You may not use any manual or automated methods like bots, scripts, scrapers, or spiders to capture/replicate any content available on Slamgator. Deceptive, objectionable, and/or illicit posts/messages/accounts are forbidden, and so is selling or purchasing accounts. You may not to share any content that goes against any Slamgator policies or regulations cited herein. You acknowledge that you may not misuse any Slamgator reporting or flagging actions. You acknowledge that you may not obtain other users’ personal information or disrupt any Slamgator operations or services. You acknowledge that we may restrict/control Slamgator use/access from time to time at our own discretion. In this regard, Slamgator may block, filter, re-categorize, re-rank, delete, omit, put on hold, authenticate or terminate your access/account/license. You acknowledge that (1) you may not circumvent such moderation, (2) Slamgator shall not assume liability for any moderation or lack of moderation, and (3) none of our actions or views relinquishes our discretion to undertake any form of moderation or not.
USER CONDUCT
You may not post, share, email or display any content that:
a) is illegal, damaging, aggressive, offensive, upsetting, malicious, slanderous, privacy-invasive, or detrimental to children in any manner;
b) agitates, provokes, humiliates, disgraces is offensive to a particular person or an group of people based on religious affiliation, race, gender, age, disability, ethnicity or sexual preference;
c) includes, provides, requests or promotes sexual-related offences including prostitution; child pornography; bestiality;
d) falsely represents an individual or organization including without limitation to Slamgator employees or provides a misleading representation of your association with an individual or organization (this stipulation is not applicable to legal, fact-based satirical content about public personalities);
e) contains sensitive personal information that may disclose a person’s identity without the person’s permission/approval ;
f) is dishonest, misleading, false, fraudulent, or involves bait-and-switch tactics;
g) violates any party’s proprietary and intellectual rights including patents, copyrights, trademarks, trade secrets, or service marks, or if you are restricted by law or have a fiduciary or contractual duty not to present or share certain Content;
h) includes any unwanted or unsolicited information such as “junk and spam messages”, “ referral links/codes”, "affiliate marketing programs”, "chain letters”, “unwanted advertisements” or "pyramid schemes”;
i) includes any kind of solicitation or advertisement that is: wrongly posted where such content is not supposed to be posted; or shared via email to other users without their written consent.

k) includes malicious programs, viruses or corrupted files intended to damage, restrict, or interfere with the functionality or performance of any telecommunication or computer system;
l) interferes with the Slamgator communication channel or disrupts other users capacity to use the Slamgator Website or Services by flooding the Site with disproportionate Content;
m) uses deceptive emails, or fake headers or other misleading identifiers to hide the source of content conveyed via the Service.
Moreover, you are in agreement that you may not:
n) communicate with any individual who does not want to be reached, or initiate unwanted communication with any individual for any business-related reasons;
o) illegally observe, monitor or harass any individual;
p) gather other users’ personal information for any unauthorized or commercial use;
q) use any automated methods like bots, scripts, scrapers, or spiders to capture/replicate any data on the Site –this does not apply if such action is explicitly authorized by Slamgator;
r) overload the Slamgator infrastructure in any way including posting inappropriate or unrelated Content, or posting identical or related content multiple times;
s) post one service or product in multiple classified categories or multiple metropolitan areas;
t) try to illegally access Slamgator systems or undertake any action that may interrupt, minimize, damage or impede the functionality, performance, and/or quality or the Site; or
u) apply any kind of automated methods or programs to automatically submit posts as opposed in order to avoid manual entry and submission of individual posts including but not limited to the application of such methods to submit multiple postings or automated submissions at predetermined times, unless with explicit approval from Slangator; or
v) apply any type of automated methods or programs to automatically initiate flags or any other type of moderation tool to automate the flagging process to avoid manual initiation of flags or misuse the Slamgtor flagging process to get rid of competitor posts, or otherwise to get rid of posts that do not infringe these Terms in any way.
SERVICE TERMINATION
SLAMGATOR RESERVES THE RIGHT TO REMOVE ANY OF YOUR POSTINGS AND/OR BLOCK YOUR ACCOUNT. Moreover, SLAMGATOR MAY FROM TIME TO TIME PUT A USER ACCOUNT ON TEMPORARY HOLD FOR EVALUATION.
Slamgator may at any particular time delete or ask you to delete any content on any basis or without any basis at all. Your account may be banned and/or Slamgator access terminated if you are found in violation of any of these Terms.
LIQUIDATED AND ASCERTAINED DAMAGES. Additionally, you agree that any violation of the USE Terms or the promotion, support, or encouragement of such violation will make you severally liable and/or jointly liable to Slamgator for liquidated and ascertained damages in the following ways: (A) gathering/acquiring Slamgator users' data, including sensitive or personal information that may disclose a person’s identity - $1 for each violation; (B) disseminating/wrong use of another party’s sensitive or personal information that may disclose such party’s identity through the Slamgator platform without the party’s explicit consent.
RENUNCIATION AND LIABILITIES. To the complete proportions permissible by the existing decrees, the board of slamgator.com which constitutes of the managers, directors, officers as well as the workers, associates, representatives and respective scions: (1) Do not provide any commitments or assurances with regard to the integrity, veracity, availability, rectitude, guarantee and timeliness of Slamgator; (2) administer Slamgator on grounds that you will incur the perils associated with its use and based on its current existing states;(3) disavow all assurances, implicit or intended, pertinent to the correctness, profitability and robustness in achieving a given goal as well as acceptable business practice and customs; and (4) disregard any commitments or answerability, exclusions or your actions as well as those of related parties pertinent to Slamgator. The individuals of Slamgator are not responsible for any and all candid, ancillary, accidental, substantial, exceptional, vindictive or any alternative damages including lost proceeds, dividends, information, altruism etc.., associated with Slamgator and there is no way such culpability can surpass one-hundred dollars or the paid amount in the previous year before the damage. Other arbitrations limit or change such renunciations and inhibits them in such a way that some may be inapplicable in your case.
INDEMNITY. You also agree that Slamgator will not be liable for any entitlements, damages, legal responsibility, or incidentals (including legal fees) that may come from any third party in connection the way you use the Site; and accept liability and responsibility for any claims that Slamgator may make against your employees, agents, administrators, associates, or any personnel paid, managed, or acting on your behalf.
MISCELLANEOUS. Users still in compliance with previously documented licenses may continue using Slamgator until such authorizations are dismissed. In other cases, this serves as the formal and exclusive agreement between Slamgator and you. Moreover, any actions we may take or fail to take towards you or other users does not relinquish, alter, or restrict these Terms in any way or our capacity to administer them. You will continue to be bound by the USE, INDEMNITY, and LIQUIDATED AND ASCERTAINED DAMAGES even in the event that these Terms are terminated. Any unenforceable term in these Terms will be restricted to the smallest extent permissible and complemented with a legal and binding provision that represents the intention of the involved parties in the best way possible.
